This End User License Agreement ("Agreement") is between you ("You") and Gamah, the developer of Rotaliate on Steam ("We", "Us"), and governs Rotaliate, its online services, leaderboards, replays and everything else We decide belongs to it (together, the "Game"). You accept it by clicking "I Agree", or by launching, installing or playing the Game, whichever We find most convenient. If You do not agree, do not play.
This Agreement is in addition to the Steam Subscriber Agreement, which governs Your relationship with Valve.
The Game is a grid of colored cells. The only thing You ever send Us during play is a stream of whole numbers from 0 to 242 (each a "Move Byte"). Every Move Byte is a rotation of a 2×2 block or a movement of the selector.
2.1. You represent and warrant that every Move Byte sent from Your account is produced by an unmodified copy of the Game in direct, contemporaneous response to the physical actuation of an Input Device by a Hand.
2.2. "Hand" means a human hand belonging to You and operated by You at the time, together with any other part of You, any prosthesis worn by You, or any assistive device operated by You in real time, by which You play. A Hand need not be a hand. A prosthesis or assistive device is a Hand only to the extent that it conveys Your physical actions, and never where it selects, generates, times, repeats or replays input of its own. "Hand" does not include the hand of any other person, or any software, hardware, script, macro, bot, solver, recording or other means that selects, generates, times, repeats or replays input on Your behalf.
2.3. "Input Device" means the keyboard, mouse, controller, touch surface, switch or other device by which Your computer registers the actions of a Hand.
2.4. Where the Game itself derives more than one Move Byte from a single actuation, including by moving the selector before a rotation or by repeating an action while an input is held, each such Move Byte is deemed produced in accordance with Section 2.1. The same result produced by any means other than the Game is not.
2.5. Remapping of controls, including through Steam Input, is permitted, provided that each actuation of the remapped input remains the act of a Hand. The decision of what to actuate, and when, is reserved to You and may not be delegated.
3.1. We may review any game, run, score, time, replay or pattern of play ("Run") at any time, for any reason or none.
3.2. If We doubt that a Run complies with Section 2, that doubt is sufficient. It need not be reasonable, explained, consistent with how We treated anyone else, or shared with You.
3.3. Where We doubt a Run, We may, without notice and in any combination: remove it from any leaderboard; remove its replay; reset Your statistics or achievements; suspend or end Your access to the online parts of the Game; ask Valve to apply a publisher ban to Your Steam account for this Game; or do anything else We consider proportionate, where "proportionate" is also Ours to decide.
3.4. You acknowledge that You were informed of this Section before any Move Byte was sent.
You may not: interfere with or overload Our servers; send anything to Our servers other than through an unmodified copy of the Game; impersonate anyone; harass other players; exploit a bug You have not reported to Us; or do anything else We reasonably consider to be against the spirit of the Game or the Code of Conduct, which forms part of this Agreement.
We grant You a personal, limited, non-exclusive, non-transferable, revocable license to install and play one copy of the Game through Steam for Your own non-commercial entertainment. The Game is licensed, not sold. We and Our licensors keep every right not expressly granted. The Game includes third-party software under its own licenses (see Third-Party Notices), and nothing here limits Your rights under those licenses.
Please stream, record, screenshot and share the Game, including in streams and videos You earn money from. You need no permission from Us, and this is an exception to the non-commercial limit above.
Most of the Game requires Our servers. We may change, suspend or stop any online feature, leaderboard, mode or the servers themselves at any time. Leaderboard positions, statistics, achievements and replays are records We keep, not property You own, and have no monetary value.
If We shut down the Game's servers for good, We will publish the source code We own for the Game and its servers under the GamahCode license, and delete the personal data We hold. We owe nothing further.
Our Privacy Policy, at https://rotaliate.io/privacy, describes what We collect and why. Replays of Your games, including every Move Byte, are kept and may be shown to others.
You must be old enough to hold a Steam account under Steam's own terms: at least 13, or older where Your country requires it.
This Agreement lasts until ended. You may end it by uninstalling the Game. We may end it or Your access under Section 3, or if You breach it. Sections 3, 6 and 9 to 12 survive.
THE GAME IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT, TO THE FULLEST EXTENT THE LAW ALLOWS.
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOST DATA, PROFITS OR RANKINGS, AND OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID FOR THE GAME. Some jurisdictions do not allow these limits; there, they apply only as far as allowed. Nothing here limits any right You have as a consumer that cannot be limited by contract.
If any part of this Agreement is unenforceable, the rest stands. We may update this Agreement; the Game will ask You to accept a changed version before You play online again. This is the entire agreement between You and Us about the Game.
